Liability Waiver

Throughout this liability waiver when we refer to ‘we’, ‘us’, ‘our’, ‘the School’ etc. we are referring to Noopoor Shyam Dance School (NSDS) and nsdanceschool.com. When we refer to ‘I’ or ‘client’ or ‘customer’ or ‘student’ we are referring to the class/workshop/performance/event paying participant or parents, carers or legal guardians.

Clients participating in or responsible for children participating in online classes with Mrs. Noopoor Chaudhary and/or instructors as ‘Noopoor Shyam Dance School (NSDS), either remotely as live-streaming, or as pre-recorded classes, are required to read and sign this liability waiver as part of enrolment and registration.

 

  1. I am participating in the online dance or yoga lessons offered by Noopoor Shyam Dance School (NSDS) during which I will receive information and instruction about dancing, music or yoga. I recognise that dancing or yoga requires physical exertion, which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.
  2. I understand that it is my responsibility to consult with a doctor/GP prior to and regarding my participation in the online lessons. I represent and warrant that I am physically fit and I have no medical condition that would prevent my full participation in the online dance or yoga lessons. Also note that failure to follow the advice of your my GP will render my insurance invalid for the purpose of claims.
  3. In consideration of being permitted to participate in the online dance or yoga lessons, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which might incur as a result of participating in the program.
  4. I understand that NSDS is not a medical professional and therefore has no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect the classes will have on a medical condition.
  5. In further consideration of being permitted to participate in the online dance or yoga lessons, I knowingly, voluntarily and expressly waive any claim and all liability I may have against NSDS its owners, agents, volunteers, assistants, employees, guest artists, faculty members, and/or students for injury or damages that I may sustain as a result of participating in the program.
  6. I understand that NSDS do not accept responsibility for loss, damage or injury arising from errors or omissions on the registration form whether completed by you or the person in charge of the student at the time of enrolment.
  7. I understand that the precise mode of teaching will be slightly different to that in an actual physical class.
  8. I understand that NSDS reserves the right to cancel a class. Parents/ Adult Students will be informed of this as soon as possible via email, Facebook and in some cases, SMS.
  9. NSDS holds Public Liability Insurance.
  10. I understand that recording of the online dance or yoga lessons is strictly prohibited.
  11. I agree to not reproduce, sell, share or distribute any recordings of the online dance or yoga lessons.
  12. I understand that music used in the videos is not property of NSDS and is for educational purposes only. By signing up for NSDS Online Dance Lessons does not grant me a license or permission to use third party copyright materials including music.
